Terms and Conditions

Welcome to askFinz. These Terms and Conditions ("Terms") govern your access to and use of the askFinz platform, including the askFinz Search web application, the askFinz Browser Extension, the askFinz Desktop Browser, and all associated services, APIs, and infrastructure (collectively, the "Services"). By accessing or using any part of the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, installing the askFinz Browser or Extension, or otherwise accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Disclaimer and Service Level Agreement. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration & Security

To access the full capabilities of askFinz, you must create an account via login.askfinz.ai. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Promptly notifying askFinz of any unauthorized access or security breach.

askFinz reserves the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.

4. Description of Services

4.1 askFinz Search Platform

The search platform at search.askfinz.ai provides AI-powered search capabilities across user-indexed content, financial data, research papers, and other data sources within the askFinz ecosystem.

4.2 askFinz Browser Extension

The browser extension performs local and background indexing of web content, manages crawl queues, applies ML-based content classification, and communicates with askFinz backend services for data enrichment.

4.3 askFinz Desktop Browser

The askFinz Browser is a custom Chromium-based desktop application with the extension capabilities natively embedded. It provides a controlled browsing environment exclusively within the askFinz ecosystem.

5. Acceptable Use

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the software.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Circumvent any access controls, rate limits, or security measures.
  • Use automated tools (other than the askFinz extension's own crawling) to scrape or index askFinz content.
  • Transmit malicious code, viruses, or harmful data through the Services.

6. Intellectual Property

All content, features, functionality, software, designs, trademarks, and trade names related to askFinz are the exclusive property of askFinz and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or authorized commercial purposes, subject to these Terms.

You retain ownership of any data you provide to or index through the Services, but you grant askFinz a limited license to process, store, and display that data as necessary to provide the Services.

7. Data & Privacy

The askFinz extension and browser perform local indexing operations on your device. Indexed metadata may be transmitted to askFinz servers for search enrichment. We are committed to:

  • Processing data in accordance with applicable privacy laws (including GDPR where applicable).
  • Never selling personal data to third parties.
  • Providing transparency about what data is collected and how it is used.
  • Allowing you to request deletion of your data at any time.

8. Fees & Payment

Certain features of the Services may require a paid subscription. If applicable, pricing, billing cycles, and payment terms will be presented at the time of purchase. All fees are non-refundable except where required by law or as expressly stated in the Service Level Agreement.

9. Limitation of Liability

To the maximum extent permitted by law, askFinz and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Services, regardless of the theory of liability.

In no event shall askFinz's total aggregate liability exceed the amount you have paid to askFinz in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless askFinz and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, indemnification, and limitations of liability.

12. Modifications to Terms

askFinz reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Services after modifications become effective constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Amsterdam, Netherlands, unless otherwise required by applicable law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
